2. Acknowledgment and Assumption of Risk
I, the undersigned, acknowledge that participating in the Valley Program on Aging Services Reason to Ride Fundraiser involves inherent risks, including but not limited to, the risk of injury, illness, or death. I am voluntarily participating in this event, or allowing my child to participate, with full knowledge of the risks involved. I assume and accept all risks of injury illness, or death that may result from participation in this event.
3. Waiver and Release of Liability
In consideration of being permitted to participate in the Valley Program on Aging Services Reason to Ride Fundraiser, I, for myself, my child, my heirs, executors, administrators, successors, and assigns, hereby release, waive, discharge, and hold harmless the Valley Program on Aging Services, its officers, directors, employees, volunteers, agents, and any other participants or sponsors of the event (collectively referred to as "Releasees") from any and all claims, demands, actions, or causes of action that I, or my child, may have or may hereafter have for any injury, illness, or death arising out of, or in any way related to, participation in this event.
4. Indemnification
I agree to indemnify and hold the Releasees harmless from any and all claims, damages, costs, and expenses, including reasonable attorney's fees, arising out of, or in any way related to, participation in the Valley Program on Aging Services Reason to Ride Fundraiser.
5. Consent to Medical Treatment
I hereby consent to receive, or allow my child to receive, medical treatment that may be deemed necessary in the event of injury, accident, or illness during the event.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.
7. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
8. Acknowledgment of Understanding
I have read this Waiver of Liability and Hold Harmless Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this Agreement freely and voluntarily and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
